Terms of service.

The following terms are for reservations on kittens purchased from Fall Creek Maine Coons. When placing a reservation, you agree to be bound by these terms, which you agree you have read and understood.

When you bring the kitten home, understand that you are responsible for all costs associated with raising the kitten. These costs will include, but are not limited to, all veterinary visits.

  1. Reservation fee

    A reservation fee is required to reserve and hold your kitten. The Buyer understands that this fee is a holding fee for the kitten, and is non-refundable unless the sale is canceled by the Seller (e.g. the Seller is unable to deliver the kitten). Payment for the reservation fee must be made online with a credit or debit card. Kittens are not guaranteed to be held until a reservation fee is paid. If a reservation fee is returned or charged back to Fall Creek Maine Coons, the kitten will no longer be held and will be made available to others.

  2. Remaining balance

    The remaining balance for the purchase price must be paid in full on or before the Pick Up Date (listed in the kitten description when purchasing). It may be paid with cash or Cashiers check in person upon pickup. Payment may be made via personal check if received at least two weeks prior to the go-home date. Please note that if the kitten is being delivered to the buyer by a third-party transport service, the kitten must be paid for before it leaves for delivery. Similarly, if the kitten is being delivered by our cattery, the delivery fee must be paid before the kitten leaves the cattery. The remaining balance may be paid when our cattery delivers the cat.

  3. Pickup

    The buyer is expected to pay for and pick up the kitten by the designated pickup date. An additional week can be granted if needed, as long as full payment is made by the original pickup date. Beyond this extra week, a $20 daily boarding fee applies, payable upon pickup.

    If the kitten isn't picked up after the additional week, the buyer will forfeit the kitten, and it will be available to others. Failure to pay by the pickup date also results in forfeiture of the reservation fee, and the kitten will be sold to someone else.

    If the kitten's health or other circumstances prevent pickup on the scheduled date, the seller will notify the buyer and arrange an alternate date. Buyers are advised to purchase refundable airline tickets, as the seller isn't responsible for transportation costs due to kitten health issues.

    A health certificate will be obtained once the pickup date is confirmed, valid for 10 days. The buyer must pick up the kitten within this timeframe; otherwise, they'll be responsible for the cost of a new health certificate and associated exams/testing.

  4. shipping and transportation

    The purchase price doesn't include shipping or transportation costs. Buyers can pick up the kitten in Pendleton, In, arrange for third-party transport, or request delivery to a mutually agreed location. Delivery costs are additional and vary depending on the location.

    If delivery is required, especially by airplane, fees must be paid before flights are booked. Prices are subject to change until payment is made. To ensure timely delivery by the Go Home date, buyers must contact us before reserving a kitten.

    If using a third-party transport service, the buyer is responsible for arrangements and costs. We aren't liable for lost fees, including reservation fees, if delivery can't be scheduled due to unavailability.

  5. Cancellation Policy

    If the buyer cancels before the kitten receives its health certificate, they'll forfeit the reservation fee, and the kitten will be available for resale.

    If the buyer cancels after the kitten's health certificate is issued or during travel, they'll forfeit the reservation fee and be responsible for additional costs, including:

    • Health certificate fee

    • Travel fee

    • Administrative fee (up to $500)

  6. Disclaim

    Fall Creek Maine Coons disclaims liability for any issues related to a kitten's appearance, temperament, size, weight, eye color, coat color, breed standard compatibility, or DNA test results. We do not guarantee the accuracy or completeness of any information provided about our kittens. This cattery has NOT been inspected by and is not endorsed by The International Cat Association, Inc

    Seller's Commitments

    Upon transferring the kitten, the seller guarantees:

    1. A licensed veterinarian's examination prior to transfer.

    2. Age-appropriate vaccinations and deworming, with records provided.

    3. Microchipping.

    4. A 72-hour warranty against viral and bacterial diseases.

    5. A 3-year warranty for congenital, hereditary, and idiopathic health defects causing death

    The seller will also provide a breeder slip for TICA registration, contingent on proof of spay/neuter.

    Buyer's Responsibilities

    Upon taking possession of the kitten, the buyer agrees to:

    1. Provide a safe, healthy environment with quality food, water, and care.

    2. Feed a high-quality, approved diet.

    3. Seek timely veterinary care as needed.

    4. Have a vet exam within 72 hours of transfer (buyer's expense) to validate the 72-hour warranty.

    5. Quarantine the kitten until the first vet visit (two weeks recommended).

    6. Introduce the kitten to other pets safely and supervise interactions.

    7. Never declaw the kitten and keep it indoors, using harnesses or enclosed areas for outdoor access.

    8. Spay/neuter the kitten by 9 months.

    9. Schedule annual vet exams, keep vaccinations current, and cover all related costs.

    The buyer is responsible for all veterinary costs and ensuring compliance with this agreement.

    Consequences of Non-Compliance

    Failure to adhere to the agreements outlined will terminate the health warranty, void all warranties, and release the seller from any obligations.

    If the kitten isn't spayed/neutered by 9 months, the warranty will be void, and the buyer will owe the seller $5,000.

    Pet Warranty Details

    1. 72-hour Health Guarantee

    • Covers viral and bacterial diseases for 72 hours after transfer.

    • If diagnosed, the seller will reimburse reasonable treatment costs, not exceeding $100.

    • Requirements:

      • Buyer must quarantine the kitten until the first veterinary appointment.

      • Buyer must notify the seller within 24 hours of diagnosis.

      • Buyer must provide proof of cost with paid receipts and detailed veterinary records.

    2. 2-year Replacement Warranty

    • If the kitten dies from a hereditary or congenital reason within 2 years, the seller may issue a one time replacement of the kitten at their discretion.

    • Requirements:

      • Buyer must have met all buyer obligations, including timely veterinary care and health insurance maintenance.

      • Seller reserves the right to require a necropsy or veterinary report to determine cause of death.

        Replacement Kitten Process

        If a buyer is eligible for a replacement kitten due to a covered health issue, the following process applies:

        1. Notification: The seller will notify the buyer via email when a similar kitten is available.

        2. Response Timeframe: The buyer has 1 week to respond to the email and accept or decline the replacement kitten. If no response is received, the buyer forfeits their option for a replacement kitten, and the warranty is terminated.

        3. Immediate Availability: If a similar kitten is immediately available, the buyer must accept it. Refusal to accept the kitten will terminate the warranty.

        4. Future Litter: If a similar kitten is not available, the buyer can choose a kitten from the next available litter. Refusal to accept the offered kitten will terminate the warranty.

        5. Pickup: The replacement kitten must be picked up within 7 days of acceptance or on the kitten's available "Go Home Date," whichever is later.

        6. Transportation Costs: The buyer is responsible for transportation costs to pick up the replacement kitten.

        7. Rehoming: If the buyer rehomes, surrenders, or resells the replacement kitten without the seller's express permission, the warranty is terminated.

        8. Necropsy Requirement: If the original kitten passes away before a replacement can be made, a necropsy must be completed to determine the cause of death. If a necropsy is not performed, a replacement kitten will not be provided.

        • The seller may send a reminder email, but it is not mandatory, and the response timeframe remains the same.

        • Buyers must accept the replacement kitten within the specified timeframe to avoid warranty termination.

    3. 1-year Deductible Reimbursement Warranty

    • Covers specific congenital and hereditary conditions listed below.

    • Reimburses the buyer's insurance deductible up to one time per kitten (up to $100).

    • Requirements:

      • Buyer must have maintained pet health insurance with a provider approved by the seller.

      • Buyer must provide detailed documentation, including medical history, insurance claims, and veterinary records.

    Covered Conditions

    The warranty covers the following specific congenital and hereditary conditions:

    1. Hypertrophic Cardiomyopathy (HCM)

    2. Spinal Muscular Atrophy (SMA)

    3. Polycystic Kidney Disease (PKD)

    4. Pyruvate Kinase Deficiency (PKDef)

    5. Gangliosidosis

    6. Vitamin D-Dependent Rickets

    7. Hyperoxaluria Type II

    8. Congenital Adrenal Hyperplasia

    9. Sphingomyelinosis (Niemann Pick Disease)

    10. Cystinuria Type B

    11. Hip Dysplasia requiring ongoing medication or surgery

    Exclusions and Limitations

    • Environmental diseases (e.g., Feline Leukemia, Rabies)

    • Accidents

    • Preventable illnesses or injuries

    • Digestive-related illnesses

    • Periodontal disease

    • Cancer

    • Shipping and transportation costs

    • Veterinary care, food, supplements, training, and other ownership costs

    • Any condition not explicitly listed as covered

    Duration and Liability

    • The warranty lasts for 2 years or until the cattery closes, whichever comes first.

    • The seller's total liability is limited to the purchase price of the kitten or $2,500, whichever is less.

    Buyer Obligations

    • Provide proper care and maintenance for the kitten.

    • Maintain pet health insurance with an approved provider.

    • Notify the seller promptly of any health issues or concerns.

    • Cooperate with the seller's requests for documentation and information.

      The warranty is provided solely at the seller's discretion, and the seller reserves the right to interpret and enforce the terms of this warranty.
